At first, he is surprised that with the legal experience that Eric Holder has, he still has the decorum of taking such grievances to a social media. Therefore, he categorically tells Holder that it is important for him to use the right channels and in this case, the court it is. While Sujit Choudhry seems disappointed by the entire issue, he also advises Holder to stop causing commotion when these issues can be resolved peacefully.

It is hard to deny the fact that constitutional democracy is the optimal system for running a nation. It provides a balanced ecosystem in which everyone has equal opportunity, and it offers a voice to the otherwise voiceless masses. Of course, all this is true only if the constitutional democracy is structured in the right way. The unfortunate thing about the very freedom that constitutional democracies provide for their societies is that it is also the source of their main weakness, according to Choudhry (

Political Crisis Creating a Major Issue

Consider Poland as an example of how constitutional democracy can lead to major issues in a nation. In 2015, a radical conservative party took majority control over the Polish government, and they had such complete control over all branches of the government that they could change the constitution with little or no legal resistance. Over the course of the years that have since passed, Poland has changed fundamentally as a society as a result of the power amassed by this right-wing party.

The fear is that something similar might happen in America. Trump is clearly a bigger fan of his own autocracy than the actual rule of law, and he would undoubtedly extend that autocracy if he could do so in a way that was considered even arguably legal. This is because there are few, if any, who would stand up to Trump when he steps across a hard red constitutional line, but there are even fewer who would stand up to him for something that makes him more powerful without directly breaking any constitutional laws.
